A warrant has been issued against a person under Section 138 of the Negotiable Instruments Act. The accused is currently missing. What steps can be taken to move the case forward? Could an ex-parte order be declared against the accused? Is it possible to attach the accused’s property for recovery? Could a search warrant be issued to locate and bring the accused to court? Please advise, thank you.

Under Section 138 of the Negotiable Instruments Act, an ex-parte order can be passed against a missing accused. The court can also attach the accused’s property for recovery and issue a search warrant to locate and bring the accused to court.
