If a cheque bounces, the payee can file a criminal case under Section 138 of the Negotiable Instruments Act, 1881. You can be arrested and prosecuted if the court finds you guilty.

I’m a student working at a security agency in India. I haven’t received my salary for the past three months despite working diligently. When I ask about it, I’m treated disrespectfully. Recently, I was given a cheque which bounced due to insufficient funds.

My friend has filed a police complaint saying I haven’t paid him, but I’ve already paid 60% in cash. He still has my cheque.

My tenant left my house in April 2016, leaving two post-dated cheques – one for ₹10,000 and another for a larger amount. The cheques were dated May 25th. When I presented the ₹10,000 cheque on that date, the bank said payment was stopped by the tenant. I don’t know his current address and haven’t deposited the second cheque, fearing it’s also been stopped. What should I do?

My cousin, who also manages my finances in another town, had been lending me money for my business at a high interest rate. Unfortunately, he misused a signed checkbook I’d entrusted him with, leading to a bounced check. He and his partner then filed a case against me, claiming I hadn’t repaid the loan. I did return the loan in cash, but their bank statements show an outstanding balance. The lower court convicted me, despite my lack of evidence proving I gave them the checkbook. I was sentenced to a year in prison, with the option of paying the remaining debt or facing another three months. I’m planning to appeal this decision in the district court. What are my chances of success?

My friend needed a TV and bought it using my documents in 2014. He promised to pay the installments but only managed three before stopping. I was in a tight spot financially back then and couldn’t cover the ₹20,000 EMI. My checks bounced, and for three years, I heard nothing from the lender. Now, they’re demanding ₹75,000 with interest, threatening police action and even got my number from my bank. I’m terrified. What can I do?
