Which Documents Are Needed ?How To Get A Copy Of A Mortgage Deed?

A Mortgage Deed is a legal document that outlines the terms and conditions of a mortgage. It gives the lender certain rights and interests over a property. The borrower’s rights to the property are pledged as collateral in the Mortgage Deed, which protects the lender. If the borrower fails to repay the loan, the lender can claim their legal rights over the property.

There are generally six types of mortgages:

  1. Simple Mortgage or Registered Mortgage
  2. Mortgage by Deposit of Title Deeds
  3. Mortgage by Conditional Sale
  4. Usufructuary Mortgage
  5. English Mortgage
  6. Anomalous Mortgage
  7. To ensure a Mortgage Deed is legally valid, you must register it. The borrower needs to sign the deed in front of at least two witnesses, who must also sign it. Additionally, you must pay the appropriate stamp duty. Otherwise, the deed cannot be enforced.

Which Documents Are Needed ?

Original Mortgage Deed: If available, provide the original deed or a copy of it.
Identification Proof: Submit valid ID proof, such as an Aadhaar card, PAN card, or passport.
Property Ownership Documents: Include documents that prove ownership of the property, such as the title deed or lease agreement.
Request Letter: Draft a formal letter requesting a copy of the mortgage deed.
Payment Receipt: If applicable, include proof of payment for any fees associated with obtaining the copy.
For any additional requirements specific to your jurisdiction, consult your local Sub-Registrar’s Office.

How To Get A Copy Of A Mortgage Deed?

To obtain a copy of a mortgage deed, follow these steps:

Go to the Sub-Registrar’s Office where the mortgage deed was registered, usually located in the jurisdiction of the property.
Furnish required details such as the names of the parties involved, the property address, and the registration number of the mortgage deed.
Complete any necessary forms or applications to request a copy of the deed.
Be ready to pay any fees associated with obtaining certified copies of the document.
Carry valid identification proof to confirm your identity during the request process.
The office may need some time to process your request, after which you will receive a copy of the mortgage deed.
For specific procedures or additional requirements, check with your local Sub-Registrar’s Office.

In conclusion, to get a copy of a mortgage deed, visit the local Sub-Registrar’s Office where the deed is registered, or check if your state offers online access to land records. Submit the necessary application with details about the property and pay the required fee to obtain a certified copy.
