How To File A Case Under the Consumer Protection Act?

To file a case under the Consumer Protection Act, follow these detailed steps:

  1. Determine the appropriate forum based on the claim amount: District Forum: Up to ₹50 lakhs, State Commission: ₹50 lakhs to ₹2 crores, National Commission: Above ₹2 crores
  2. Draft the Complaint. Include details like complainant and opposite party details, facts of the case, relief sought, signature of the complainant
  3. Collect documents like receipts, warranties, and any prior communication with the seller.
  4. Pay the fees depending on the claim amount. For items up to ₹5 lakhs requires no fee. Moreover, for items from  ₹5 lakhs to ₹10 lakhs fees can add up to ₹200. Lastly, for items that cost more than 10 lakes, the fee would be 400 rs. 
  5. Submit in person or online at the appropriate consumer forum, attaching all supporting documents.
  6. After submission, a hearing date will be set, and both parties will be notified.
  7. Present your case; failure to attend may result in an unfavourable decision.
  8. If dissatisfied with the outcome, you can appeal to a higher forum within the stipulated time frame of two years from the date of the incident. 

How To File A Consumer Complaint Online? 

To file a complaint online through the National Consumer Helpline, follow these steps:

  1. Visit  (consumerhelpline.gov.in) and create an account by providing your name, email, contact number, and a password.
  2. Use your credentials to log in to the portal.
  3.  Click on “Register Your Complaint” and fill in the necessary details about your complaint, including your details and those of the opposite party, date and time of purchase, description of the issue, relief sought, relevant documents (e.g., receipts, warranties)
  4. Pay any required fees through the online payment gateway.
  5. After submission, you will get a unique ID to track the status of your complaint.
  6. You can check the status of your complaint using the unique ID provided. For assistance, contact the helpline at 1800-11-4000 or 14404, or use the NCH app.
