How To File A Case In The National Consumer Disputes Redressal Commission (NCDRC)

The National Consumer Disputes Redressal Commission (NCDRC) is the apex consumer disputes redressal forum in India. It has the power to hear appeals against decisions of state and district consumer forums.

If you want to file a case in the NCDRC, you need to follow the following steps:

  1. Firstly, you need to draft a complaint in the prescribed format. The complaint must be signed by the complainant or his authorized representative and should contain the following details:
  • Name, address, and contact details of the complainant
  • Name and address of the opposite party
  • Facts of the case
  • Relief sought
  • Supporting documents

  1. Once the complaint is drafted, it needs to be filed with the NCDRC. The complaint can be filed in person or sent by registered post or courier to the registrar of the NCDRC.
  2. Along with the complaint, you need to submit a demand draft of the prescribed fee. The fee is calculated based on the value of the goods or services and the compensation sought.
  3. After the complaint is filed, the NCDRC will issue a notice to the opposite party asking them to file their response within 30 days.
  4. Once the opposite party files their response, the NCDRC will fix a date for the hearing of the case.
  5. During the hearing, both parties will present their case and the NCDRC will make a decision based on the evidence presented.
  6. Order: After hearing the arguments and examining the evidence, the NCDRC will pass an order. The order will specify the relief granted or denied.
  7. Appeal: If either party is dissatisfied with the order of the NCDRC, they can file an appeal in the Supreme Court of India within a specified time period.

It is important to note that the procedure for filing a case in the NCDRC can be complex and it is recommended to seek the assistance of a lawyer who specializes in consumer law.
