My grandmother passed away in 1991 without a will, leaving behind a piece of ancestral property she inherited from her father. She had two children, my uncle and my mother. While the property hasn’t been officially divided, my uncle’s name appears on the land records. My mother has received no share. Since my uncle is willing to share, how can my mother legally claim her rightful portion of the property?

As your grandmother died intestate (without a will), the property would be divided equally between your mother and uncle under the laws of inheritance. Since the property was inherited from your grandmother’s father, it falls under ancestral property rules. Your mother can initiate a partition suit in court to claim her share of the property. This suit will require proof of your grandmother’s death, her ancestral lineage, and the current ownership status of the property.
