I worked as a Junior Assistant at Manappuram Finance for the past two years. However, I was hospitalized for two months due to typhoid fever. Since I couldn’t attend work, my name was removed from the payroll. The company sent me letters about rejoining, but I did not receive them on time. Now, I am fully recovered and have submitted my medical certificates to the company, but they are refusing to reinstate me. Can you please help me resolve this issue?

Under Indian law, a company can dismiss an employee for poor performance, including communication skills, even after 12 years of service. However, the dismissal must be justified and follow due process. The employee is entitled to their gratuity and final payment upon termination, regardless of the reason for dismissal.
