CHITAMBARESH, J -------------------------------- Tr.P(C) NO. 353 OF 2013 ------------------------------------ Dated this the 22nd day of July, 2014 ORDER The wife has filed HMOP No. 1164/2013 on the file of the Family Court, Thrissur for restitution of conjugal rights. The husband has filed O.P. No. 270/2013 on the file of the Family Court, Kasargod for divorce. Both the cases have to be jointly tried since the issues are intertwined.
It is a virtual impossibility for the wife to travel all the way from Thrissur to Kasargod for the conduct of the case. This is especially so since she has to look after the minor child born in the wedlock. It may only be a slight inconvenience for the husband to travel from Kasargod to Thrissur for this purpose.
I therefore order transfer of O.P. No. 270/2013 from the Family Court, Kasargod to the Family Court, Thrissur. The transferee court shall issue notice to the parties and expedite the proceedings. Every endeavour shall be made to dispose of the marital disputes within a period of six months. The Transfer Petition is disposed of. V. CHITAMBARESH JUDGE ncd
